Holy crap. Don't do anything without a lawyer. Hospitals have gangs of lawyers. If you have a solid case (which it sounds like you do) many lawyers will take the case on contingancy ( if you win they get paid). Yes it can take years to take care of I've been fighting my old insurance company since 2000 over an accident.

On a lighter note I'm glad to read that your dad was alright.

Now why didn't the hospital call the police when they couldn't find him? Do hospitals have a the waiver now "we are not responsible for any people left here for treatmen. Leave loved ones here at own risk" I would not let this go. As soon as a business or anything else tries to make you out in a bad light the know they fucked up and are trying to pass the guilt for a stupid employee or staff screw up.l

I strongly recomend that you do not proceed with this by yourself. The fact of the matter is, that you do not know what your rights are in a situation like this.



Its true that lawyers fees might be about 1/3 of your total award. However, you will never know how much you can actually get from them in the first place.



If the hospital decides to go on the defensive, and they most likely will, and they find out that you are proceeding alone, they will eat you alive. The paperwork they will ask you to sign contingent on your getting your settelment will have such convoluted and complicated language that by the time you are done reading it you will not know which way is up. I just don't want you to give up your rights, Phins. And as I already mentioned, untill you get a lawyer involved, you might not really understand what your rights really are.

Im sorry to have heard about all of this after the fact. Glad you found your father and nothing tragic happened to him while he was on the streets. Couple things I wanted to point out. You said your father had an Iv in him which means he also had on a hospital gown. Am I the only one thats not bothered by the fact he walked 7 blocks and no passing motorists or pedestrians thought something was a little peculiar? I would think the least people would do is call the police if they saw someone walking down the street like that. You also said the hospital claims he checked himself out. I can hardly believe that if you said he just had surgery and was doped up on meds enough to make him incoherant. Besides dont you have so sign yourself out if you decide to leave? Where's his signature that he thought he was stable enough to leave. I know last year I had to have someone sign me out because I was too out of it to realize what was going on. Its kind of like a protective custody. You claim to take responsibility of that person until they come around even if the patient is of legal age. My honest opinion is to get a lawyer as well. There are soo many quirks and loopholes that its best to atleast consult with an attorney about the situation even if you decide not to use that particular one. I can name plenty of times I wish I had a lawyer to give me advice rather than do what I thought was the smart thing. All in all it is worth it. About the whole clearing the hospital bill thing: How does your insurance play a part in that? I guess that would only really benefit you if your insurance doesnt cover any of the bills or if you dont have insurance at all. Good luck with whatever you decide to do and take into consideration your dad is the one who really suffered. Everyone's utmost concern should be his well being and comfort. Good Luck
