Defamation and Slander on the Internet
Most states require by law that you can't post, print or say anything that could hurt a business on the internet even if there is an issue with that company unless. 1 you have given them written notice that you will do so if the issue isn't resolved. (You did this in your e-mail, now for where you messed up) 2. After written notice has been given and received then you have to wait, most states require around 3 months for the company in question to fix the problem, but you'd have to check with your state of Florida and California as well since that's where sportscarmotion is located. (You waited 4 days; it's nice of you to post the e-mail dates in your copies of the e-mails messages and on 3 diffrent RX7 forums that I've seen) For this reason it is very possible that sportscarmotion could get a lawyer and sue you as well, and probably for more $ than your 2 injectors and lawyer fee's. Just thought you'd like to see where you've made a big mistake. Maybe you should go ask your lawyer about that and spend some more $ since you want to bring the law in to a very simple miscommunication. You should also learn how to 1. READ and 2. Not be an ass. I'm sure you would get a lot more respect and help with any issues that you need help on in the future. |
I thought slander cases are only brought when the supposed incodent was untrue.
It sounds to me like himni is trying to get things worked out, and I hope it is, but I have been stiffed before (not by loi), and the only thing that kept me from driving 1000 miles to the guys house and kicking him in the nuts was the lack of an address. I'm puzzled how it would be considered slander to post your experiences with a company. SLANDER: Slander is a spoken defamation. CAN I SUE SOMEONE WHO SAYS OR WRITES SOMETHING DEFAMATORY ABOUT ME? In order to prove defamation, you have to be able to prove that what was said or written about you was false. If the information is true, or if you consented to publication of the material, you will not have a case. However, you may bring an defamatory action if the comments are so reprehensible and false that they effect your reputation in the community or cast aspersions on you. So no case could be brought against Himni for what he has said. |

A comment on defamation and slander: If he's telling the truth then it's not defamation or slander. I'm not taking his side, just letting you know that he can post whatever he wants as long as it's true.

Threatening a business is usually not the best way to go about getting your money back. I had some trouble with Sportcarmotion, but I stayed polite and patient and everything worked out in the end.

If the remark is truthful and it "hurts", is embarrassing, or subjects you to ridicule, there is little you can do. Unfortunately, unless the remark is false, you have no recourse. defense is claiming, and proving, that the statement is true, for "truth is an absolute defense". There is NO case, sorry. Update: Sence before my last post, I have talked to Loi, via email, and we left it as, he was sending me the money ($200) for the two injectors that are wrong. When I get the check, I was going to send the two injectors back. (packed and ready)
That was over a week ago, no money/check has showed up. Just to keep ya up to date. |

You guys should do one of those escrow things, they do them on ebay, he puts the money in an escrow deal and when he recieves the item you both sign off on it and you get your money.

I just ordered my exhaust from Loi. We exchanged about 5 e-mails back and forth and then I called him. All this in less than 30min. He even gave me a great deal and threw in a shirt for me. I think maybe it's you and not him... I have nothing to say but good things about Sportcarmotion!

It was a joke, this topic has served it's purpose, it's never really been on topic, I have been more then patient with your personal attacks at me, but it's getting old. if you attack everyone that attempts to help you, then that more then likely is the reason you are getting no where with your current issue.
