Well, just to let you all know that are curious. i guess i can post about this now cause i was told to wait til court was over with. i had a long day. court seems to take too long. was kinda funny cause the first case was about a couple old men and painting a house with 4 gallons of paint. that seemed to take a long time, yet was funny to hear. anyways back to the subject for those who need to know.





first off i'd like to THANK JEFF CLARK of Jeffs Auto for showing up as expert witness for me. he was real helpfull in explaining everything about the engine function to the judge. i don't wanna get into pacifics cause we were in there for awhile. but main ending was judgement was that I WON!!!!!!!!!!!!!

SO, POINT BEING DON'T BE AFRAID OF COURT. JUDGES ARE YOUR FRIENDS.

now i gotta admit i didn't get all i asked for. but the money wasn't the issue. as all who know me knows. it was about TAKING CARE OF CUSTOMERS. so this is all i have to say about it right now.

was awarded $729. i guess the resons were it only had 1 month left on the warranty and a big reason was the use of the nos. yet the judge couldn't see or understand that nitrous is not horable. as unlike a supercharger shoving hot air into the engine. ( i meant to print this, ut didn't make time)



There are three points. First, nitrous oxide is comprised of 2 parts nitrogen and one part oxygen (36% oxygen by weight). When the nitrous oxide is heated to approximately 572F (on compression stroke), it breaks down and releases its load of extra oxygen, However, it is not this oxygen alone which creates additional power, but the ability of this oxygen to burn more fuel. By burning more fuel, higher cylinder pressures are created and this is where most of the additional power is realized. Secondly, as pressurized nitrous oxide is injected into the intake manifold, it changes from a liquid to a gas (boils). This boiling affect reduces the temperature of the nitrous to minus 127 Degrees F. This "cooling affect" in turn significantly reduces intake charge temperatures by approximately 60-75 Degrees F. This also helps create additional power. A general rule of thumb: For every 10 Degrees F. reduction in intake charge temperature, a 1% increase in power will be realized. Example: A 350 HP engine with an intake temperature drop of 70 Degrees F, would gain approximately 25 HP on the cooling affect alone. The third point, the nitrogen that was also released during the compression stroke performs an important role. Nitrogen acts to "buff or damper" the increased cylinder pressures leading to a controlled combustion process and better slower heat release.





so i screwed up. cause the judge was thinking that nitrous heated everything up. yet he listened to dave who didn't have or want to give the facts straight. oh well.

I would have figured nore money awarded but it is good that this is "somewhat" over and that you have proved that the big guy doesn't win all the time. Atkin's got less that what was coming to them, but at least you won and hopefully they learned a lesson... They would have been out a heck of a lot less if they would have just stood behind their work.

Amazing, yet shaking my head – what more can I say? First of all, I am happy over the outcome of the case. It is nice to know that the judicial system validated what we believed was true and gives me faith in the judicial system. I am very proud of Kettlman for standing up for what he believed was right. It takes a strong and courageous person to do what he did. He stood up and won for all of us that were affected by this.



I can not deny the relief that this is over, but at the same time, I am shaking my head over this. I just wonder if all the energy that went into the hard feelings, the mean and devious dealings, the accusations and the just plain garbage of the past few months had been put into trying to figure out why these engines were failing, just think where this community would be.



I am also trying to deal with my feelings toward what happened at the RX7 Club. When this issue came up, instead of allowing people to vent or discuss this case, the owner of that forum succumbed to the pressure and what is so ironic is that instead of diffusing the situation, it only escalated it.



I am also shaking my head over how all of the bashing, and loss of faith in a company could have been prevented. Although I am excited over the change that is occurring with my car, it is sad to think that the key reason for making the change was the total loss of faith and confidence that I would have received good customer service if anything had happened to the supercharger. I just hope that a lesson has been learned by all this – that companies need to provide good customer service and to treat customers with respect.

My company would never treat a customer that way. If a customer comes up and says "I wanted cheese on this", we put cheese on the burger, no questions asked. And we throw in a hot apple pie.

Last night I was reading the old RX-7 Club archives -- posts from 2000 and 2001, which is when the current version of the RX-7 Club was just starting (the first two versions died in the Flame Wars of 1999 and 2000). Anyway, in 2000 and 2001, people were starting to complain about Hayes Rotary and Mazdas And More, and we know what happened to them.



The word spreads quickly on the internet. Bad customer service, lies, and deceit may have worked in the old days, but ever since the internet websites got started, the word spreads too fast for a business to control. The lesson to be learned in this episode is that the flow of information cannot be controlled, and an unethical business will pay the price.



History is very interesting.

I often wonder why anyone who frequents a community as small as this one (rotary), would attempt to conduct business in a less then appropriate manner all the while expecting no consequences for thier actions. The affore mentioned companies should have realized this from the past problems and or mistakes and learned from it, instead of becoming part of the aggregate domino effect of companies whom continue to have thier reputation tarnished by poor customer service, less then average quality, and the "my product will last just long enough for the check to clear the bank" attitude.



Congratulations, it really is a win for us all.

The problem with some people is that they get greedy. So an honest days pay for an honest days work isn't worth the effort to them. They cut out part of the work but not the price. They make a better profit but cut there market and put themselves out of cutsomers. Some customers want to cut the price but not cut the work to be done for them. They put good business and employees out of work.

still some great customer service goin on . talked to Kathy today to find out about getting the judgment money. i was hopeing they would have just stuck it in the mail last week and got it over with. but i was told i had to wait till Dave got back on the 15th. that will be 27 days from the judgement. was hopeing to be able to say something good about prompt service. guess i don't get to.

If you don't get your money as soon as he gets back, I would take the judgment papers to Nasty Collection Agency and let them handle it. Also, the collection agency will have further ideas for you that I'd rather not go into here.. some things are more fun when they come as a surprise.
