Trade In Drivers License...

so i have a revoked NYS drivers license. long story, short: i forgot to send in proof of insurance, after i was pulled over, and couldnt present the insurance card (it was in the trunk, i forgot i thru it back there)



anyways. i've been told i can just go to another state (planning on going to mich, cuz i have a few friends attend Umich, whose address i could use) and turn over my NYS state drivers license, and have a mich one mailed to me within a month.



is this true? dont they check NYS records? cuz obviously if they did, my license would show revoked. but my friends said it didnt SEEM as though the mich dmv checked ****. all they did supposedly, was take their NYS state license, punch a hole thru it, take down current mich address and take a pic. is it that simple?

As long as you can prove you have insurance, sure. I f you move to another state you can just take there test all over again, could take up to 2 weeks tho.

so you saying they DONT check info? such as license revokations in other states. =T

they check? blast. i cant get insurance in my current state, cuz my license is revoked. BLAST BLAST BLAST!

NYS wont revoke your license for no insurance, there is another issue here, get a lawyer and he will tell you how to get your license back, you may even be able to get out of that ticket, if you have someone who works in a insurance office have them draft you a letter saying you had insurance on that date.



And by the way, if you didnt have insurance on the car it would come up as the registration being revoked, and your license would come up as suspended. Which means they would have arrested you on the spot.



I dont think you know all the facts and should get yourself a lawyer.

rob it takes a while for your licence to get suspended once your insurance lapses.

i had my nys license revoked after i had a motorcycle accident while riding an unregistered, bike in 1994. the bike had insurance, but it expired 3 days before the accident. i had the accident the day after i returned home from orientation at the university of michigan

(great school)

the cops gave me 9 tickets while i layed on the ground unconcious waiting for an ambulance.

i went to court 6 times and the cop lied every time saying that he saw me crash the unregistered bike, my defense was that i was walking the bike home from a friends house, when i was hit from behind by a hit and run driver. anyway, my case went all the way to the superior apeals court in the city, long story short, after much headache, i won my apeal after 15 months, but my revocation was for 12 months, so the city still basically won.



during that 15 months i was at school in michigan, and tried getting a liscence over there. it was very difficult as they want you to prove that you have been a resident for 5 years before you can get a liscence there. all the NY students tried that ****. some finally got it in senior year right before graduation. it may have changed now though.



what majors are your friends taking up foopy? i was a mechanical engineering major living in bursley hall (best year of my life) :bigok:



foopy try to get a virginia license, there is no emissions test there, and its much closer than michigan

you get a letter from your insurance company telling you if you dont

pay your insurance by midnight of a certain date, they will notify DMV and your license will be suspended. DMV gives you a 15 day grace period with no penalty. If he really had insurance and just couldnt find the card as he said, he should have no problem at all. If he had no insurance, then he is screwed, but he said something like he just couldnt find the right card.



Now, even though your license wont get suspended right away, your registration will be suspended once your insurance lapses.

okay i guess long story short didnt suffice:



i was pulled over for speeding, but he let me go on that, but i couldnt present my insurance card. it was in the trunk like i said. cop tells me to simply mail in the ticket, with a photocopy of the insurance card, and everything would be cool. LIKE A ****** ******* (excuse the langauge, but - as im sure many would agree - few other words can do justice to my moronic action) i didnt. this was back in august 2002. according to the dmv, in decemeber of 2002 (just this past xmas) my case was closed, cause i never responded. all the notification letters were sent to my old address, and not forwarded.



moving along: my 21st bday just rolled by late last month, i eagerly awaited my new license (remember, like a F'in A-hole, i complete forgot about the ticket) and to my surprise 3 weeks passed and nothing. i called the dmv to see wuts up. they said my license was revoked - driving without insurance is automatic license one year license REVOKATION (not suspension; if it matters) and also a civil fine of 500 bux.



i am gonna fight this, and its relatively simple to do it, but it takes 3 months to re-open the case. if anyone knows a hastier way to get my license un-revoked, do tell. i have proof that the car was insured and wut not, but like i said, 3 months to re-open case.



but i see a silver lining, cuz i WANT to get a mich license, and insurance/plates (two birds one stone, nyc insurance is killer). i say mich, cuz they have no emissions or registration stickers (stickers are ugly, and i dont want them on my windshield, yet another lovely thing required in nyc). Oh, and another thing is i'd only need one rear plate, sweet deal, front looks nicer without it.



VA would be cool too, but i dun kno anyone there whose address i could use. it is closer, but i could stay with my friends at mich and get some partying in too.



my main concern is wheter they check the NYS records or not.

friend is a junior now, just like me, and lives off campus in an apt. he's an aerospace engineering major. thanks for your advice.

As long as you did in fact have insurance at that time, you wont have a problem AT ALL. Get proof of insurance, a photocopy of a insurance card IS NOT proof, you can get a insurance card after making one payment and its good for 6 months-a year. You will need to get a letter from your insurance company stating you had insurance in effect on that date. Once you do ANSWER the ticket you should get the scoff law lifted until your court date, you dont even need a lawyer for your problem, if you did in fact have insurance.

A lawyer will however know how to get your driving privilages restored right away and know how to cut thru the red tape, a friend of mine is a criminal lawyer and spends half his day in DMV so trust me on this one.
