Maybe I will feel better if I tell others. Because this is eating a giant hole in me right now.



I will break this down as simple as I can:



-3 years ago the city ran new water and sewer lines down this street.

- Common practice is do take a fron end loader and scrape all the nails and disks the surveyors set off the road to eliminate confusion for the water line installation crews. ( I guess 25 year old markers showing property lines are confusing)



-2 years ago we were hired by a builder to mark a lot in this block for new home construction.



- This builder requires a 10 day deliveryof a survey after they order. I quit fromthem because it is sometimes impossible to meet that deadline. When you miss that deadline a bitch from their office calls on day 11, 12, 13, 14 etc.. and...well...bitches you out for not having it done. We got sick of it and quit.



- When my crew tried to survey the lot they found nothing left in the road to determine where the lot should go. They proceeded to look for peoples front lot corners 30 feet from where the nails used to be.



- The crew misjudged the existong home placements by 1 lot.

- The drafter (who is supposed to be checking for this and I pay good money to to do so) never checked their notes to see if they made a mistake but led me to believe he had. (this was a chronic problem with him, I fired him and hopefully there are not anymore of these floating around)



- The new home was built one lot in the wrong place.



- 1 year ago the owner of the lot that the house is on drove by and saw a house on his lot.



- It turns out the owner of the lot is very wealthy and owns 400+ lots in this town.



- He gets a lawyer and files an "ejectment notice" with the home owner, basically telling him to get out of the house he owns it now.



- Man in house freaks calls builder.



- Builder never calls me (I quit from them and they are mad at me, subcontractors dont quit they just get abused) but instead calls Title company.



- Title company sends me a letter asking if the house is in right place.



- I personally go to site and discover, yes its 1 lot off.



- Owner of lot fires his lawyer because he wants every penney he is about to make.



- owner of lot calls me and tells me I can buy his $20K lot for $50K and make this all go away.



- I tell him I will get my insurance involved as this is getting out of hand.



- Insurance takes over.





Now, this exact situation happened to a friend of mine. His house is 7 lots in the wrong place. They discovered it when selling it. They contacted the owner of the lot (who lived in Jersey) and the owner of the lot laughed and said to just deed over the vacant lot to him. This man was the epitome of a ture gentalman.



Well, like Phins I have encountered not gentleman but money hungry ******** who have found an opportunity to *** rape me for money.



Bottom line?



The man that owns the lot decided to raise his price to $55K and my insurance agreed. He just sold a lot worth $20-25K at best for $55K.



The man living in the house got $45K in compensation for "emotional distress".



My insurance policy for that year would cover up to $100K in damages.



Pretty slick huh?



So what I want to do is after all this is over is write a letter to the two ******** thanking them for *** raping me over an honest mistake where no one was harmed and was easily fixed. I want to tell them that I hope they make a mistake in their lives and I can only hope and pray there are ******** like them there to *** rape them the way they did me. I will pray every day that bad karma comes back to get them.



This could have been handled in an attorneys office in about 3 hours the day they discovered the mistake. This, instead has dragged on for a year now with 3 attorneys duking it out.



Cannot WAIT! to see my insurance renewall premiums next year.



We do about 2500 home a year so over the last 4 years there are 10,000 surveys out there. so far? we are batting 1 in 10,000. Hope this is the last.



Now I will continue w/ my insomnia....

Whoa.. That is crazy .. Sorry to hear that Jims.. I hate how paople see the opportunity to make a buck or two for something that really could have been fixedd like you said.. in a couple of hours.. People like him deserve all the bad life is willing to throw at them.. and sometime that is just not enough..

And that folks is why I got out of surveying. I never put a house on the wrong lot, but I put a house over the easement lines by a few feet. Foundation was already poured before they found the problem and was tore out after adjoining homeowners raised hell, and replaced for around 10k from what I understand. It was really this ******* drafter in our office that fucked up the plans for me when I went in the field. Then he was nice enough to put all the blame on me knowing damn well he screwed up. He managed to get away with that **** continually cause he was buddy buddy with the main owner of the company. It was the 2nd time he had screwed up foundation plans in a very short period of time for me. Lordy there are actually too many fucked up stories to even think about that still **** me off....



Well I feel your pain Jim. Ready to fly planes, play with rx7's and mini's in Oklahoma yet?

I know this probably doesn't really apply here, but I found it very interesting. Couple years ago when I took the NC state survey exam and prepared by going to various seminars, there was a guru survey law expert that spoke. He explained that (at least in NC) if you have say 10 lots that are 100' wide and a surveyor goes out there to reset the corners that were knocked out and makes them 90' wide, the guy who owned that 10th lot no longer owns anything. I and others were a little confused by that, but it basically boiled down to the fact that if a surveyor puts an iron where he thinks the corner should be from all the evidence gathered, thats where the thing is and thats final. How well that would really hold up in court is another question.

You already know my thoughts on it. I hope he sleeps well knowing that cash in his bank account came from extorting someone who made an honest mistake, well no actually I don't, I wonder how he does sleep.



At least you got the insurance company involved, who knows what would have happened if you didn't.



The guys I used to work with at my last job were like that, they would rather sue someone then work the **** out and they couldn't figure out why I wasn't impressed when they would run around bragging how they fucked some guy and put him out of business for something stupid that could have been handled with a phone call. Hell they even sued their biggest customer because they figured out before they accepted the shipment they were getting SCREWED and told us to go **** ourselves.

WOW!! This guys is a real chunk of sunshine. Nothing like kicking a fellow man in the head after he triped. Some will do anything for another buck. It's sick!! I would guess that this guy would also kill other people for money if it was legal. He'll get what's comming to him!



Jim, rest your mind knowing that this guy isn't truly happy and at this point, never will be. He will always be on the hunt for another "fix" of happiness through moeny. Kinda funny Makes me want to knock on his head and say " hello, lab partner, ya can't touch real happiness dumb ***" LOL

What sucks the most. The dude that owns the lot, calls me, now,.. I have a really bad temper, so when he says give me 50K and this will go away I blew a gasket on him. Hence the extra 5K on the lot price. I know that extra 5K was because I got pissed at him. I told him straight up about my friends lot and that I could not understand why he is making such an issue over this. It was not like this lot was the future site of his dream home it was one of 400 lots he owns. He lives in a 3/4 million home. I have his address and have surveyed in his neighborhood.



What really pisses me off is the fact that the Title comapny told me to sit tight they would take care of it. Then they just pushed this aside for over 6 months thus causing the emotional distress on the homeowner. I suddenly got a letter from the homeowners attorney stating he is suffering emotional distress over the long delay. The title comapany caused the emotional distress but because it was my mistake it is all my fault.



When I first contacted my attorney over this he laughed at the emotional distrss thing and told me we will demand to see doctors bills showing treatment for such. Next thing I know we see no doctors bills and we are dishing out 45K to this guy.



Sometimes I feel like my own lawyer isn't even on my side.



Sidewinder - Retaliation already crossed my mind but would get me no where as I would be a prime suspect.



I had thought about telling every friend I have to go out in front of the guys house who got 45K and do burnouts whenever they go near there. Talk about emotional distress that would give him some real distress.

Welcome to modern day conservative capitalism. If some idiot has the chance to make a buck, then he will. Finding someone that would fix it without financial damage is very rare. I went through some problems with an inheritance, in which someone tried to screw me over, just because there was money involved. I would definitely hope that those two people get whats coming to them, and that their properties get hit by a tornado or a flood or something. I really hope that they realise what they've done to you, and maybe offer some sort of compensation. However, thats unlikely, no one helps their fellow man anymore... the whole capitalism thing again. If they can **** you over, 99% of the time, they will. Thats one of the statements I live by.
