So the person is answering his emails. I don't know too much about internet laws but is hacking a website like that illegal? I am sure they can trace the email account to a person buy IP address. If they do go after this guy can they prosicute him? How severe could the punishment be?

i doubt you would get much help out of the feds, they prolly aren't going to go after someone for defacing a site, think how many get defaced everyday.
