So I Get Pulled Over This Morning...

Minding my own business on my way to work...in my totally legal 91 n/a (intake, N1 single catback)...I make my way thru a small town...as I do every morning. Speed limit is 40mph...I'm doing 40.cruising at like 2K rpms. Out of nowhere a state cop flies up behind me...almost to the point of tail-gating. I'm thinking "wow, if this guy has any intent of pulling me over...he better have a damn good reason." As soon as I end that thought in my mind, lights go on and I find myself stopped on the side of the road.
The officer walks up to the car...with me having my license/registration ready hoping for a quick transaction:
Officer: "License...registration...Do you know why I pulled you over?"
Me: "Honestly, I have no clue"
Officer: "Your exhaust is too loud"
Me: "really?"
Officer: "Yes, how long have u had it on?"
Me: "Over 3 years!"
Officer: *dumbfounded*
Me: "Not only have I had it on for that period of time, But I have also passed state inspection on TWO occasions over the past 3 years with it in place"
Officer: *dumbfounded* (again)..."Well, its too loud"
Me: "So are you contradicting your own STATE LAWS? (pointing to me inspection sticker)...Can I please see your decible meter so I know what level I am at?"
Officer: "No, I don't have a decible meter...but its too loud...I'll be back"
takes my license/registration and spends about 10 minute in his car....at this point I know he's probably writing me up for it. Comes back...nervous
Officer: "Sir, this is a summons for a loud exhaust."
Me: "And the reasoning behind this is...........?"
Officer: "There is a new law for loud exhausts."
Me: "Oh really...Why then as a tax paying citizen did I not receive information about this?"
Officer: "If you want to plead not guilty, info is on the back...I have to go"
I was thinking "WTF...dude, you got shot down on every question I asked...having no answer what so ever...and now you have to split...come back...I want to argue this with you!"
This guy was definately a newbie...he had no clue how to handle my questions or the whole situation. I think he was expecting to find an immature rice-boy in the car...not a well educated guy who knows all about state exhaust regulations all too well
The $44 fine doesn't bother me that much...but its the fact that this guy had no right to even give it to me in the first place. Over the past 2 years...I've been pulled over twice...both for speeding. Both times the state officers made NO reference at all to my exhaust note AT ALL...just gave me warnings and I was on my way...
I REALLY wanna show up in court and defend against this guy...I have all receipts from the exhaust 3 years ago...and have write ups on my passing of inspections with it in place..not sure if its worth taking a day off or just paying $44...but I know I'm right dammit! LOL

just ask in court who tuned his ears to perfectly receive the dB level of an exhaust note.
without a meter he cannot judge if your exhaust is too loud and i know of NO cops equipped with decibel meters except some in cali.

he has no case, summon the officer into court. Take it to court. You dont need to take a full day off work for it. Ive been in many traffic courts, i fight all my tickets. And I assure you, if you present your case in a professional manner and show evidence (pictures, video, reciepts, etc) you will almost always get off.
But this is easy, cause you are really innocent.. lol

this should be an easy win...ive gone for illegal left turn and getting off on it
but this you really dont even need an excuse or evidence. just say that he gave you a ticket for loud exhaust, he had no instrument to measure it in, and that the ticket is false. it will automatically be dismissed, if not, then tell them to go out back and measure it

At no point should the officers Opinion come into play here!
The only way they'll stop doing that ****, is if you take it court!
Otherwise, they'll keep giving these tickets to get thier $44 dollar bonus!
