In Jersey, you can't buy back a totaled car...dunno why.
i am going to have to call bullshit on this as i live in jersey and have bought back more than one car that has been declared totaled. (for less than $400 each.... )
Maybe its by insurance company then? I had two wrench-head friends who were unable to buy back totaleds from State Farm.

Good article on it:

http://info.insure.com/auto/collision/totalling.html

"If your car is a total loss but you want to have it repaired anyway, you should be able to retain it. Your insurer still has to pay you the car's actual cash value, minus the deductible and minus what the company would have gotten for it at the salvage yard. You should let your claims adjuster know up front that you want to keep the car. You're then going to have to pay for the repairs yourself.

In most states, your car is gone for good once it goes to auction. Regulations vary, but in many places you won't even be able to attend the auction without a special license for auto salvagers or auto dealers. It's good to call the auction house beforehand to see if you will need a license in order to bid on your car"

the way i have done it more than once was to leave the car at a place who will give you a storage fee per day. get the car there ASAP so the tab starts. after about 2 weeks the decision will be made and insurance company will start negotiating a price to pay you. (you obviously argue their price, but thats another topic) then after you do decide to agree to a price, you say that you will take the payout they have offered minus the storage fee and YOU will hold the title. i have done this with state farm too BTW....

another thing is to make sure you take it to the dealer yto get an estimate. YOU pick who fixes the car, NOT the insurance company. they have to pay, thats it.... if they do not declare it totaled, mazda is the highest price you will get for an estimate. you then (after they cut their check) take the car to the place of your choice. (read, not the mazda dealer)

yeah i was planning that the only problem is the car would have to be towed to the place. i guess i can make the people come to my house. i hold the title for my car. i figured it would be better if i had the car at my parents house simply because nothing can be *missing* and i would be better off along with the whole towing thing.... but yeah i'll give you a call if i have any questions

that was a very smart move.

A friend who wrecked his car badly went into the hospital, i didn't know he crashed until he saw me 3 weeks later.

While he was in the hosiptal the car was in the impound lot/insurance adjusteres.

When he got back he was missing a alpine deck, all the amps, the door panels were ripped open and the speakers taken out.

He was also missing his set of VOlk racing rims, he had snow tires on in the middle of the summer?

The insurance coampny says that is how the car was and that he would not be reimbursed. He called a lawyer, two days later the insurance company paid retail price for everything he listed on his car.

i talked to my friend for some advice he said it shouldn't be my fault and i would have to take pix of the skidmarks with a ruler and get him print outs from that site and then he can change it from unsafe speed

i do have to wait two weeks though
