I dont think any lawsuit can be brought about, even if someone went and

photographed your car in a parkinglot and used it there is nothing illegal about it.

Maybe if they put it on a calender and sold it, but just to put your cars pic on a web site its fair game.



Its the same as celebrities, people take thier pics all the time and put them in newspapers and even web sites, they dont get paid jack **** for it.

actually that's an advertisement which is used to promote revenue, which means they make money off the ad, therefore a form of royalty should be paid.



The reason they don't have to pay is because van has a website on the "members rides" section of said website and in there Terms Of Service i'm sure they state somewhere that "all pictures used on these websites become property of sounddomain.com and cardomain.com"

I think you'll find that the owner of the car has no rights to prevent the use of a photo like this. Unless the person taking the photo has broken some other law such as trespass (to take the photo) etc i don't think that you can do anything about it. This is why as suggested before, that famous people do not get any money for the use of their photos in magazines and newspapers.



The only thing that you may have an action for is if they are suggesting (falsely) that the person who owns the car is endorsing some kind of product that they are not.



This is a quick comment on the laws in Australia- I would expect that the laws are similar in the US as they have similar origins.
