First off he never said he was speeding. Second, the weather was the major cause of him spinning out. And third he was able to stop the car without damaging it. He was hit after his car came to a stop. Think about it...

Just because he was not speeding doesn't mean it was not his fault. Unless there is more to his story, he spun on his own accord, not caused by anyone else. Therefore it is his fault. He should have been going slower given the weather conditions. Unless it was a sudden flash flood he was driving through, in which case he can feel free to blame the rain. If there was 3 feet of snow on the ground and I decided to drive my 7 somewhere, spun out and hit a tree, would it not be my fault? Would I be an idiot? Yes. Would my insurance cover it? Most likely. My fault? Of course.



And he was hit because he was stopped (caused by his spin out) in the middle of the highway, on a rainy day. If I was driving in the rain with someone behind me and suddenly decided to slam on the brakes and stop as quickly as possible for no good reason, would the person behind me be at fault for panicing, locking his brakes, and hitting me? Of course not.



Think about it...

I said that because the same thing happened to my 4runner. My insurance didnt go up...And I was in the same exact situation. Hit by a lady in her volvo after I spun out. Her insurance paid for everything....It is the vans resposibility to cover his losses.

Ok, got it, you're talking about who the insurance company will find fault with. Not the person who actually caused the accident. In that case you are probably right, the insurance will probably deem it a "no fault" accident, despite the fact that he caused the accident. Similar to your situation.

just like my accident............ i tried to avoid someone goin like 90mph....... and he just kept driving....... i talked to someone at my insurance company and not only will my insurance go up if i claim it, but so will every other car in my household......... if i had someone to blame, then i wouldnt even have to worry about a thing

someone called vosko lucky in reference to his fd? lol...he hasnt crashed cause it's been in the shop half the time lol



just poking fun since i dont even have one to be able to crash should get it soon court is almost over hopefully!



Anyway my conolences to all who lost a loved one, the fd of course, but hey at least you're all still around think of the unfortunate ones who crashed and couldnt get out alive, that sucks and I know i drive very carefully in an attempt to prevent not only myself from crashing but to prevent me from making anyone else crash.

Okay....I look at my car before and afterwards and still don't understan how I survived. Its mind blowing that I walked away. I did some research afterwards because I thought my insurance was going to go up and when I compared the cost of being insured on a 99 civic and a 94 FD the prices almost came out to be the same. When I looked up the crash test ratings the Rx-7 kicked its butt! The mortality rate in a civic is like 10 times higher. Is this because their are 10 million civics and only 13,000 Fd's or is it proportional????

I was the origin Person that posted this and I got my estimate on the car today. The estimate was plus of minus $800 on $5300. The guy is storing my car for free because he thinks it such a cool car and he thinks it will attract people to his shop. He also said that when the insurance pays for it he can put a body kit on it instaed of going with the stock parts. Anyone got any kit suggestions? So everything is going ok for accept for my back now. Thanks for all the replies that everone has given sympathy for me.

The answer to the question about if I was going to fast for conditions is that I wasn't I was just getting on to the freeway and I hit a big *** puddle of water and the put me out of control. Later guys
