My grandmother was driving my older brother and sister and me to school about four years ago, and we stopped in front of this private school, behind a few cars because the front car was waiting to turn. SO we're sitting there, and this bitch quickly-ex-friend-of-my-sister's comes flying over the hill at 55mph and slams into us. Her silverado (With a brush guard) bounced back a bit, and she panicked and instead of hitting the brake, she floored it back into us again! There was a cop sitting right there, in front of the private school, facing us, saw and recorded the whole thing. My grandmother's 2001 Ford Windstar was accordianized and the frame bent in three directions, the hatch completely destroyed. I got a steel rail thrown into my shoulder blade, my brother's 40lbs backpack hit his head, my sister was bent down at the floor in the front seat to answer her cell phone and my grandmother is lucky to be alive. So we crawl out of the car, and the cop comes over and asks my grandmother who is hardly coherent at the time, if we need an ambulance! Uh, duh...No ambulance ever came. The girl, who was the school mascot warrior princess chick, didn't so much as get a slap on the wrist from the cop and claims that she 'didn't see we were stopped' and 'she was too busy arguing with her little brother'.
The police officer asked my grandmother if she would 'move her van off the road'! That was pretty much it. The police report got filed and the battle with the girls insurance company started. It took FOUR YEARS to settle, and we only got 11 grand out of the deal, that's all the bitches insurance would supply! Thank god for G.A.P. Insurance which paid off the remainder of the 21 thousand Grams owed, and bought the car from her for like 2 thousand I think. This bitches insurance made my grandmother DRIVE the car all the way to my mechanic's collission center.
The windstar had three rows of seats. Two front buckets, two captains chairs and a bench in back. The hatch area had been destroyed all the way to the bench. The bench had been off center to the right. Both captains chairs were facing opposite directions and the front seats were facing toward the left. The frame had been torqued in three ways and the body panels were all rippled like water.
I tore most of the muscles in my neck and shoulders. My brother suffered from only a headache where his bag hit him. My sister torqued her back and ripped something in her shoulder and my grandmother, thank god, only suffered a chip in the heel of her right foot where she hit the brake pedal. According to the doctors, and faster probably would have killed my sister and me.
So yes, take that bastard to court and fight them on everything. YOU WERE HIT, that's obvious and it isn't your fault someone wasn't paying attention.
Case in point.

Oh, what's really fucked up is that the girl made a comment in the year book at the end of the school year, in an interview. The question was:
What was the most memorable thing to happen to you this year?
A.) "Oh, well, I had a little fender bender early on, but it isn't really worth mentioning. The cop was very nice and recognized me as the OCHS Warrior Queen!"
BULLSHIT FENDER BENDER! You bitch, you totalled a ******* van!

If the light turns yellow and people go through the intersection, you will be aware of the vehicles crossing through that are obeying the light. Yellow light is for people already at the intersection or in it (depending on the speed limit).
If you had enough time to think "Yeah it should be okay now" and then you pulled out, the driver was either:
a. not paying attention and decided to go through not really knowing how long the light had been yellow
b. speeding and decided he/she didnt have enough real estate to slow down before the light turned red
c. didn't want to stop for the light so he/she sped up to "make it"
it's all grounds for reckless driving up here in Canada anyways.
I would be taking them to court, myself.
