I recently got caught doing 95 in a 65 in new hampshire (with lidar). I was given a court summons as opposed to a standard violation. Does anyone know if I will definitely be charged with reckless driving in this circumstance, and if so, if I have any defense? I think I might be able to plea down to a standard speeding ticket/big fine but I want to prepare for the worst. I mean, I'm sure an rx7 at 95 can still respond faster than a normal car at 65 anyway (although I doubt that defense would work at a trial https://www.nopistons.com/forums/pub...IR ).

Best suggestion would be to seek legal advice from an attorney. If you hire one they are usually able to get better results in court than you are because they know the loopholes and what to say.

I agree. You may be screwed either way, but with a lawyer, you're much more likely to get a break. Only downside is that with a lawyer, you'll probably get screwed twice. Once by the judge, and once by the lawyer when you pay his bill. https://www.nopistons.com/forums/pub...1047683785.gif

the judge isnt gonna care that your car is better/faster etc, 95 in a 65 is still breaking the law.

my friend got out of a ticket once because the cop got him for like 45 in a 25, but it was 100feet from the stop sign, and we were able to take a road test of the car and say theres no way a 1st gen rx7 can do

0-20in that amount of space, let alone 45. judge wasnt happy but he did get a smaller fine

Lazer hasn't held up too good around here. Apparently the depts. have trouble keeping all the paperwork up to date. The lawyer got me out of a 101/65 because the calibration was out of date.

Something also seems weird about them not naming your charge.

Hire an attorney.

When you get pulled over for speeding, ask the officer if he/she calibrated the radar gun, and when it was last calibrated. Also ask for the model of the radar gun. Then look-up the model specifications on the net. Most radar guns are suppossed to be calibrated by a trained technitian on a daily basis. So, if the officer claims that he/she calibrated the radar gun, or calibrated it too long ago, you might get off on a technicality. Remember though, this is all based on the model specifications, so ask when you get pulled over before the officer can change their statement.

If they actually try to charge me with reckless I'll probably hire an attorney (assuming the premium hike costs more than the 2k for a lawyer). I might get lucky and they'll just give me a fat fine. Two other people got pulled over at the same time doing over 80, so it wasnt like I was dodging through traffic....It was such an open road and a clear day that everyone was speeding. I just think the cop has something against rotarys and/or people from massachusetts https://www.nopistons.com/forums/pub...IR#>/smile.png

theres a big difference between 20 over and 30 over, at least there is here. here for 30 over they can take you right to jail if they want to

RE4 11-18-2005 02:03 PM

You could claim you were just going with the flow-of-traffic. https://www.nopistons.com/forums/pub...#>/biggrin.png

Or you could say they racially or rotarylly discriminated against you.

With the discrimination I assume your a female of African/American/midget decent, also a senior citizen with a missing limb, deaf, or mentally challenged.
