We have started an online petition for submission at the end of January to the government and leaders of the opposition at http://www.petitiononline.com/sect1722/petition.html. We have been working hard to contact the local and wider Ontario based owners and motorsports clubs in order to solicit their support, and their members support. We have also started speaking to our various club sponsor shops and dealerships in the Toronto area; we have asked other owner's clubs to get their preferred performance shops on this; we have joined the SEMA Action Network and sent them information on the legislation asking for their assistance in fighting this; we have been contacting Ontario manufacturers of performance parts, and now we ask for your support, as a responsible, legitimate business in Ontario, as enthusiasts for our sport, and as a retailer of parts threatened under this legislation. We would ask that you tell the government, your MPP, the Premier and the Minister of Transportation by personal letter what the loss of the Ontario market could mean to your firm, and other shops and manufacturers of these parts in Ontario.



I would like to hear more on your position on the issue at hand, and what you feel should be done to correct this impingement on our shared passion and your business, and thank you for your time and consideration on what is unfair and unjust legislation. To hear more debate on the issue, and what grassroots owners in Ontario are trying to do.

Basically, Ontario is trying to ban all aftermarket parts for your vehicle!

Even if I did live in ON, I wouldn't sign the petition. Have you even read the legislation?? It does not intend to ban all aftermarket parts. Nor does it, as some in other forums have implied, give police discretion. I don't mean to be insulting, (though I know it is...) but the petition seems more like fear mongering than responsible citizenship. All that you guys fear is not likely to happen. So they'll likely ban NOS. Is that such a big deal?? To inspect your car, the police must have caught you street racing, otherwise there is no reasonable and probable grounds. The legislation shouldn't be as much concern as the regulations the lt. gov. will make.

Sounds like a ban to me...

I'm sure much more than just NOS is on that list "prescribed parts" list.

Um, yeah, but there isn't yet a prescribed list of parts, so they haven't banned a thing. That list of parts is "the regulations" I reffered to. They can't willly nilly make up parts, and the parts can't be so vauge as something like "aftermarket exhaust." Note also the "prescribed circumstances." Trust me, you guys shouldn't be that worried about the legislation, worry about the regulations.



Regulations



172.2(9) The Lieutenant Governor in Council may make regulations,



(a) prescribing substances, parts and equipment commonly used in racing for the purpose of this section;

(b) prescribing circumstances for the purposes of subsection (1);

© exempting any class of persons or vehicles from any requirement or provision of this section or of any regulation made under this section, prescribing conditions for any such exemptions and prescribing different requirements for different classes of persons or vehicles.

22. Part X of the Act is amended by adding the following section:



Prescribed substances, equipment for racing prohibited



172.2 (1) No person shall drive or permit to be driven on a highway a

motor vehicle with a prescribed part, containing a prescribed substance or

equipped with prescribed equipment in prescribed circumstances.



Sample inspection



(2) A police officer exercising his or her powers under section 82 may take

or cause to be taken a sample of any substance from a motor vehicle to

determine whether or not the motor vehicle contains a prescribed substance.



Seizure and disposal of prohibited substances, etc.



(3) A police officer exercising his or her powers under section 82 may,



(a) remove any prescribed substance, part or equipment from a vehicle and

dispose of them, or cause their removal and disposal, at the cost and risk

of the driver and owner, who are jointly and severally liable; or



(b) order the driver or owner of the vehicle to remove any prescribed

substance, part or equipment from a vehicle and disposed of appropriately.



Deemed service



(4) Service of an order under clause (3) (b) to the driver of the vehicle

shall be deemed to be service on the owner of the vehicle.



Offence



(5) Every person who contravenes or fails to comply with subsection (1) or

an order of a police officer under clause (3) (b) is guilty of an offence

and on conviction is liable to a fine of not less than $200 and not more

than $1,000 or to imprisonment for a term of not more than six months, or to

both.



Sample analysis



(6) The Minister may authorize any person or class of persons to analyze a

sample of a substance taken under subsection (2) at the request of a police

officer.



Evidence



(7) In any proceeding instituted under this Act, a certificate of analysis

of a substance, in a form approved by the Minister, that is issued and

signed by a person authorized under subsection (6) is proof, in the absence

of evidence to the contrary, of the facts stated therein and of the

authority of the person signing the certificate to make the analysis,

without other proof of his or her authorization.



Forms



(8) The Minister may require that forms approved by the Minister be used

for any purpose of this section.



Regulations

Yea... until I see a list of just what I can get on my car? I'm still all for the petition.

Doesn't sound like I can use much does it? Perhaps I misunderstand.
