My question is whether I have a legitimate claim against the garage who has done most all of my repairs and maintenance.



The water pump froze on the freeway, broke 2 or 3 fan belts and burst the radiator open... all before I knew what was happening. By rthe time the warning buzzer announced a problem and I exited a nearby off ramp, the engine died and wouldn't restart.



I have baby'd the car since 1990 when I bought it, and replaced the 13B non-turbo Feb 2002. after 108,000 miles. I put another 20,000 miles on the new engine before this happened



Consider these facts:

1. The new engine (Mazda factory rebuilt) was installed with new hoses, belts gaskets, plugs, catalyst, etc.... but NO NEW WATER PUMP.



2. When I asked why they didn't replace the WP, the boss said "it didn't need it".



3. The engine would no doubt be alive today, if the water pump had been renewed.



Two other mechanics have told me that a water pump replacement is SOP when engines are replaced. So, Do I demand that the garage replace the engine at their cost ... and be prepared to sue in small claims court if necessary?



I'm hoping some of you readers wil have the answer (I'm a 73 year-young retiree, living on very little income).

I think you have a good case to sue. do it up.
